How do we use your personal data and what is the lawful basis for processing it?

SEAT, S.A. (hereinafter, “CUPRA”) will process the personal data by your provided, as well as other personal data that CUPRA may have access through the use of the “Contact us” form for the main purpose of managing your request and contact you to fulfill your specific request, enquiry or claim.

In addition, and only if you have consented it, CUPRA will process your personal data for the marketing purposes activities that will allow us to send you information and special promotions about products or services of CUPRA.

The legal basis for each processing is the consent of the data subject. You may withdraw your consent in any time without affecting the lawfulness of processing based on consent before its withdrawal.

What other recipients will the data be disclosed to?

In order to manage your request, where necessary, CUPRA may communicate your personal data to the Importer in your country or to your SEAT SERVICE. In any case, they will only process the disclosed personal data for the purpose established above, that is to say, fulfilling your specific request, enquiry or claim.

Base on the above, if your Importer or SEAT SERVICE is located outside the EU, this might involve a necessary international transfer of your data, only for the purposes abovementioned.

Likewise, your personal data can be disclosed in order to comply with legal obligation.

How long do we retain your personal data?

CUPRA will retain your personal data for the time necessary in order to provide you with an answer in regard to your request, while the erasure of your personal data has not been requested by you as well as during the time necessary in order to comply with the legal obligations needed in each case.

 Access

 You can obtain from CUPRA confirmation as to whether your personal data are being processed and access to your personal data.

 Rectification

 You can obtain the rectification of inaccurate personal data concerning you. You also have the right to have incomplete personal data completed.

 Erasure

 You may request the deletion of your personal that when, among other reasons, the data is no longer necessary for the purpose that were collected.

 Object

 You can object to the processing of your personal data. CUPRA will no longer process your personal data unless it has compelling legitimate grounds for the processing or for the establishment, exercise or defence of legal claims.

 Restriction of the processing

 You can request the restriction of the processing of your personal data where one of the following grounds applies:

  • The accuracy of the personal data is contested by you, for a period enabling CUPRA to verify the accuracy of such data.
  • The processing is unlawful, and you oppose the erasure of your personal data and request the restriction of their use instead.
  • CUPRA no longer needs your personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
  • You have objected to the processing, pending the verification whether CUPRA’s legitimate grounds override yours.

 Portability

You can receive, in electronic format, the personal data that you have given us and those that have been obtained from your contractual relationship with CUPRA, as well as to transmit them to another entity.

 To exercise your rights, you must attach a copy of your ID or another document which proves your identity and clearly indicating the right you want to exercise. You can exercise these rights by sending an email to customercare@cupraofficial.com or by written request addressed to SEAT, S.A., Autovía A-2, Km.585, Martorell, Barcelona (Spain). The exercise of these rights is free of charge.

If you consider that CUPRA has not processed your personal data in accordance with the applicable regulations, you can lodge a complaint with the relevant supervisory authority.
